I. Basic Provisions
These General Terms and Conditions (GTC) govern relationships in the sale of goods between the company DISKUS, spol. s r.o. (hereinafter referred to as the “Seller”) and its business partners (hereinafter referred to as the “Buyer”).
An integral part of the GTC is the Complaints Procedure.
Seller
DISKUS, spol. s r.o., with its registered office at Kunětická 2534/2, 120 00 Prague 2, Company ID: 411 95 183, VAT ID: CZ41195183,
registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File No. 4503.
Buyer
A person registered in the Commercial Register or a person conducting business on the basis of a trade license, or a person conducting business on the basis of authorization other than a trade license pursuant to special regulations, or a natural person acting as a consumer.
Legal relationships between the Seller and the Buyer not expressly regulated by these GTC or by a contract between the Seller and the Buyer are governed by the relevant provisions of Act No. 89/2012 Coll., the Civil Code, as amended, as well as related regulations. An individual contract with the Buyer takes precedence over these General Terms and Conditions.
By purchasing a product that is part of the Seller’s commercial offer, the Buyer does not acquire any rights to use a registered trademark, trade name, logo, etc., unless otherwise agreed by a special contract.
II. Security and Privacy Protection
The Buyer provides the Seller with information about the company name and registered office or place of business, legal status, Company ID, or VAT ID if the Buyer is registered as a VAT payer.
The Seller declares that all personal data are confidential, will be used solely for the performance of the contract with the Buyer, and will not be disclosed or provided to third parties without the Buyer’s consent, except in cases related to distribution or payment transactions concerning the ordered goods (communication of name and delivery address).
III. Orders
Orders may be placed in the following ways:
– via the customer portal (www.diskus.cz, www.itreklama.cz or www.sportovnisluchatka.cz)
– by e-mail,
– in person,
– by telephone.
The Buyer receives the goods at the price stated in the price list at the time of ordering. Upon dispatch of the goods, a delivery note and invoice are issued unless otherwise agreed.
Accepted orders are binding and may be cancelled only upon payment of a cancellation fee amounting to 10% of the price of the ordered goods, unless the Seller and Buyer agree otherwise.
If specific goods are not in stock, the Seller shall inform the Buyer in writing, by e-mail, or by telephone of the expected price and delivery date. The Seller may change the price of the goods until dispatch due to the current market situation and depending on the exchange rate development of CZK against foreign currencies. The Seller shall inform the Buyer of any price change before dispatch. In the event of disagreement with the price change, the Buyer is entitled to withdraw from the order without penalties.
The Buyer may not withdraw from a contract for the supply of goods customized according to the consumer’s wishes or for their person, as well as goods subject to rapid deterioration, wear, or obsolescence.
Information about products in the Seller’s online catalog and price lists is for illustrative purposes only and may differ in details from the delivered goods.
IV. Payment Terms
Payment may be made in the following ways:
– cash payment upon collection of goods at the Seller’s premises,
– cash on delivery upon delivery of goods (cash collected by the carrier),
– advance payment by bank transfer,
– payment by bank transfer within the invoice due date.
The goods remain the property of the Seller until full payment has been made.
V. Delivery Terms, Method of Transport
Personal Collection
Goods may be collected for the Buyer only by a person authorized by the company owner or the statutory body of the company, or by the Buyer acting as a consumer. This person must sufficiently identify themselves, i.e., present a valid identity document (ID card or passport).
Delivery by Transport Service
The Buyer is obliged to check the condition of the shipment together with the carrier immediately upon delivery (number of packages, integrity of the tape with the company logo) according to the attached delivery note and, if necessary, refuse acceptance of an incomplete or damaged shipment. An incomplete or damaged shipment must be reported immediately (within 24 hours) to the Seller by e-mail or telephone, based on a damage report drawn up by the Buyer together with the carrier. If the Buyer confirms receipt of the shipment by signing the carrier’s documents, any subsequent claims regarding incompleteness or damage to the delivery cannot be accepted.
VI. Warranty Conditions
Warranty conditions for goods are governed by the Seller’s Complaints Procedure.
VII. Personal Data Protection
- The Seller declares that all personal data are confidential and will be used solely for the performance of the contract with the Buyer, marketing activities, commercial offers, and access to customer portals www.diskus.cz, www.itreklama.cz and www.sportovnisluchatka.cz.
- No provided personal data will be otherwise disclosed or provided to third parties, except in cases related to transport or payment transactions concerning the ordered goods.
- Buyer’s Consent to the Processing of Personal Data: By completing registration (i.e., filling in the registration form, checking the box and submitting the completed registration form in the customer portals www.diskus.cz, www.itreklama.cz and www.sportovnisluchatka.cz, sending the required data by e-mail or providing them by phone to a sales representative), the Buyer grants consent to the processing of personal data provided under these GTC by the Seller as the data controller for the purpose of carrying out a business transaction, offering goods and services, and accessing customer portals. The Buyer also grants consent to further marketing processing of personal data under these GTC, in particular for sending commercial communications and newsletters.
- Validity of Consent: The Seller shall process the Buyer’s personal data in relation to completed business transactions on the basis of the granted consent and statutory obligations for a period of 10 years. Data obtained through registration for access to customer portals www.diskus.cz, www.itreklama.cz and www.sportovnisluchatka.cz are stored until the Buyer requests deletion of their data from the database by e-mail. Providing data is a necessary condition for registration and purchase of goods and takes place via contact with a sales representative (e-mail, phone) or by completing the registration form on www.diskus.cz or www.itreklama.cz or www.sportovnisluchatka.cz.
- Withdrawal of Consent: The Buyer’s consent to the processing of personal data under these GTC is voluntary. The Buyer is entitled to withdraw this consent at any time by e-mail to gdpr@diskus.cz or in writing to the Seller’s address (DISKUS, spol. s r. o., Sokolovská 154, 180 00 Prague 8). After withdrawal of consent, the Seller shall ensure that all Buyer’s data are deleted from the business database and user account and that such data are no longer processed. This does not affect the Seller’s obligation to process the Buyer’s personal data for the period required by applicable legal regulations or in accordance with them.
- Buyer’s Access to Data: From the moment of registration, the Buyer has the right at any time to request information from the Seller related to the processing of their personal data in accordance with personal data protection principles.
VIII. Final Provisions
These General Terms and Conditions are valid from 1 October 2021 and replace all previous provisions and practices.
The Seller reserves the right to amend these General Terms and Conditions without prior notice.
